Bankruptcy Education Disclosure


We understand that you came to Consumer Credit Counseling Service of Northern Illinois, Inc. f/k/a Consumer Credit Counseling Service of McHenry County, Inc. (“CCCS”) because you have filed for bankruptcy and are required to receive approved budget education before you may discharge your bankruptcy. CCCS is approved by the Executive Office of the U.S. Trustee to do pre-bankruptcy counseling and pre-discharge education and issue certificates in compliance with the Bankruptcy Code 11 U.S.C. 111. The U.S. Trustee has neither reviewed nor approved any other services we offer to clients and approval does not endorse or assure the quality of a provider’s services.

CCCS has over 35 years of experience helping people with financial problems. Our role is to provide assistance, not to be judgmental. Specifically, we will instruct you on how to do a workable budget that will reflect your financial situation, discuss the factors that may be the cause of your problems and explore options for developing a reasonable plan for dealing with them. We will provide you with information about rebuilding and maintaining good credit. We will also consider strategies to resolve your problems. We believe that the purpose of this course is to provide you with information, so that you may choose the options that you think are best for you. At the conclusion of this 2-hour class, the agency is obligated to promptly provide you with a certificate that you will need to discharge your bankruptcy. You will only receive a certificate if you complete the entire 2-hour class. If you are taking the bankruptcy course on-line (Money In Motion) our agency will provide you with a certificate of completion upon notice of completion of the course; and no later than 3 business days from the completion of the course. The ultimate goal is to make sure that you need not file in the future and that you attain the skills to maintain good financial health and rebuild your credit. As part of the course you will be required to take pre- and post-tests before receiving your certificate.

CCCS of Northern Illinois is a member of the National Foundation for Credit Counseling (“NFCC”). The NFCC has high standards for quality credit counseling and financial education and this agency complies with those standards. In addition, this agency is accredited by the Council on Accreditation (“COA”), an independent third-party organization that reviews and monitors entities that provide social services. We are a not-for-profit agency. We are organized and operate in accordance with Section 501(c)3 of the Internal Revenue Code and are licensed by the State of Illinois Department of Financial Institutions.

The Certified Counselor conducting or supervising this session has been trained in accordance with the NFCC standards, and while he/she has expertise in helping with those financial problems, he/she cannot provide you with legal advice. In fact, this session is designed to provide you with information and alternatives, not to make financial decisions for you.

In order to assist you, it is essential that you provide us with information that is as accurate and complete as possible. Be assured that the information concerning your financial condition and status that you provide us during this session is strictly confidential. Such information would include, but is not limited to: income, debts, credit accounts, earnings, assets and employment data. We will not disclose any such information that you provide orally or in writing to anyone, except as authorized by you in writing; as part of a compliance review; to the United States Trustee in their oversight of this agency or during the investigation of complaints, during on-site visits or during quality service reviews; or as required by law, such as in response to a subpoena. We may compile data and aggregate information that you give us, but this information will not be disclosed in any manner that would personally identify you. This agency will not disclose or provide any information about this session to a credit reporting agency.

Bankruptcy education is provided as a class or an online course. The fee for this class in person is $50 for one person and $75 for couples who has filed jointly and are taking the course together. If you are taking the class by internet, the fee will be $40 for one person and $60 for a couple who have filed jointly. There is a $15 discount for the on-line class if you completed your pre-bankruptcy counseling through us. (So the fees would be $25 for individuals, $45 for joint filers). Individuals with a household income under 150% of the federal poverty guideline may be entitled to a reduced fee or a fee waiver. If you think you qualify for a fee waiver, please call us at 815-338-5757. No one shall be denied services due to inability to pay a fee. Certificates will be issued at the end of the in-person class or upon notice to CCCS that the client has completed the on-line course.

Pre-Discharge education is offered on-line or in a classroom setting to clients in English and Spanish. Other languages can be accommodated; however, the client will be required to provide a translator. Or to find an organization that provides these services, please go to the U.S. Trustee site at . The agency also receives funding in the form of grants from United Way, the McHenry County Mental Health Board, HUD, Citicorp, Bank of America, the Bersted Foundation, the McHenry County Mental Health Resource League, local banks, and donations from major creditors who participate in our clients’ Debt Management programs.

Consumer Credit Counseling Service of Northern Illinois, Inc. (CCCS) offers budget & financial counseling, credit report review, debt management programs, pre-filing bankruptcy counseling and pre-discharge bankruptcy education, reverse mortgage counseling, pre-purchase counseling and education, as well as foreclosure mitigation counseling, and “CheckWise” education. I understand I am not obligated to receive any of the other services provided by CCCS.

CCCS and its employees have no conflict(s) of interest due to any other relationship with services, real estate agencies, mortgage lenders and/or other entities or industry partners. The agency does not pay or accept referral fees. No fees are either paid or received by our agency for the referral of a client to a bankruptcy attorney or any bankruptcy alternative agency.
